RENTAL POLICY, TERMS & CONDITIONS

RESERVATIONS can be made online, by email, or by calling our reservations desk during regular office hours. Prices are quoted per night for 7-night minimums or 2-4 night minimum stays during some periods and for overnight accommodations where available. Online bookings require acceptance of terms and conditions and valid credit card information. Reservation bookings require a 50% advance rental payment on reservations made greater than 31 days prior to the arrival date or 100% advance rental payment for reservations made 30 days or less prior to the date of arrival. Acceptance of the terms and conditions of this Rental Policy at the time of online booking or a signed Rental Agreement must be received within 7 days of the booking date to confirm a reservation otherwise your vacation Rental Agreement may be cancelled without notice. For offline bookings, a vacation rental agreement will be sent to you after the reservation has been made. This document will detail cost, due dates, terms, conditions, and policies. The down payment includes half the rent, half the sales taxes, and the non-refundable fees: $45.00 reservation fee and $45.00 Accidental Rental Damage Insurance (ARDI).

BALANCE DUE  The full balance of your vacation rental amount is due in our office 30 days prior to the arrival date. If not paid 30 days prior to the arrival date, Holiday Vacation Rentals (HVR) shall have the right, without further notification, to deem the reservation cancelled without refund of advance payments. Personal checks are acceptable for advance rental payments and balances due, provided the check is received 30 days prior to the arrival date. Otherwise, the payment must be made by MasterCard, Visa, or AMEX. Final payment will be charged to the credit card used to make the reservation unless another method of payment has been provided when the final payment is due. A $45 service charge on all NSF checks will be added to your balance. All advance rent amounts and security deposit, if charged, will be held in Holiday Vacation Rentals Trust Account at First Community Bank, Harbor Springs, Michigan.

ACCIDENTAL RENTAL DAMAGE INSURANCE (ARDI) is included in every rental in lieu of a security deposit. ARDI protects you for up to $1,500.00 in covered damages and inadvertent acts or omissions during the duration of your stay. See Accidental Rental Damage Insurance for details on insured coverage. Renter shall be responsible for damages not covered under ARDI resulting from negligent acts and for the cost of extraordinary cleaning. Holiday Vacation Rentals has a thorough inspection policy to ensure our rentals are in good condition upon arrival and that Renters will not be inadvertently billed for missing or broken items. Please assist us by reporting any missing or broken items to our office within 24 hours of check-in. If damage, breakage, or spills occur during your stay, please notify us immediately.

All SEASONS VACATION RENTAL TRAVEL PROTECTION PLAN is available as an option on each reservation. The Vacation Rental Protection Plan provides insurance coverage in the event your travel plans become interrupted due to medical and other covered emergencies. The charge for the insurance is 7% of rent, taxes and non-refundable fees. The All Seasons Travel Plan must be paid for prior to the final payment due date or at the time you make your reservation.  Holiday Vacation Rentals does not refund payments in the event of inclement or severe weather. Insurance coverage is underwritten by the National Fire Insurance Company of Pittsburgh, PA, with its principal place of business at 70 Pine Street, New York, New York 10270. It is currently authorized to transact business in all states and the District of Columbia. NAIC No. 19445.

SECURITY DEPOSIT  Accidental Rental Damage Insurance (ARDI) waives the need for a security deposit. A security deposit, when charged, is refundable within 30 days of check-out and after a thorough check-out inspection of the rental. The security deposit is NOT applied to rent. Your reservation will not be checked-in until payment has been made. NO REFUND on prepaid rent or fees will be issued to customers refusing to pay the security deposit when due. Renters may pay the security deposit by check, MasterCard, Visa, or AMEX. Holiday Vacation Rentals shall deduct from the security deposit charges that result from, but are not limited to:  1. Damage repair.  2. Broken or missing item replacement.  3. Extraordinary cleaning.  4. Late check-out.  5. Keys and garage door openers not returned. 6. Carpet or upholstery cleaning.

CANCELLATIONS  In the event of a cancellation, notice must be given via email or in writing to: Holiday Vacation Rentals, 6789 S. Lakeshore Dr., Harbor Springs, Michigan 49740. If a reservation is cancelled sixty-one (61) days prior to the arrival date, one hundred (100) percent of the rental amount, less the reservation fee of $45 and a $150 cancellation fee will be refunded. If cancelled between thirty-one (31) days and sixty (60) days prior to arrival date, fifty percent (50) of rental amount, less the reservation fee and the cancellation fee will be refunded. If a reservation is cancelled thirty (30) days or less prior to the arrival date, and if the property is re-rented for the original rental amount, one hundred (100) percent of the rental amount paid, less the reservation and cancellation fees will be refunded. If re-rented for less than the original rate, Renter will receive the balance of the rental amount, less the reservation and cancellation fees. If the property is not re-rented, or if there is payment outstanding, no refund will be paid. If the All Seasons Vacation Rental Travel Plan insurance was purchased, the premium is non-refundable. THE VACATION RENTAL PROTECTION PLAN IS HIGHLY RECOMMENDED TO PROTECT AGAINST UNEXPECTED TRAVEL DELAY, CANCELLATION, OR INTERRUPTION.

UNFORESEEABLE CIRCUMSTANCES  Holiday Vacation Rentals bears no responsibility in the event of loss of power due to weather, electric company outages, water company outages, inclement weather, or any circumstances beyond our control. NO REFUNDS or cancellations will be offered for such circumstances.

CHANGES TO RESERVATIONS AND TRANSFERS are subject to availability and may be made up to 60 days prior to check-in within the same property only and must be in the same calendar year. Transfers between rental rate seasons from higher rate to a lower rate will be charged the higher rate. Transfers from a lower rate season to a higher rate season will be charged the higher rate with additional rent due immediately. All transfers are subject to a $150.00 non-refundable fee due at the time the transfer is requested.

REQUESTING SPECIFIC UNITS Vacation rental properties are privately owned. Holiday Vacation Rentals will make reservations for specific properties subject to availability. We cannot always guarantee a specific rental, such as if a change of owner or maintenance requirement occurs. In those situations we will make every effort to transfer your reservation to an equal or better rental without charge.

FURNISHINGS AND EQUIPMENT  The properties that Holiday Vacation Rentals represents are private residences and are individually decorated. Décor reflects the taste of the owner and varies widely. Homes are equipped with dishes, cookware, flatware, glasses, and basic appliances. Bed linens and towels are provided. Please be sure to pack any specialty items that you may require during your stay. In some locations sports equipment, snowmobiles, jet skis, and boats may be rented locally.

FIREPLACES where available, are for use during cold weather only, and may not be used while the air conditioner is running.

HOT TUBS and pools are maintained between guests. Since neither the homeowner nor Holiday Vacation Rentals’ employees are on the premises during the use of these amenities, the rental party agrees to be solely responsible for the use and operation thereof. Renter will be charged for mid-week spa treatment or cleaning resulting from overcrowding or misuse.

CONDITION OF PROPERTY All equipment in the units should be in working order. Please report any inoperative equipment to our office immediately. Every reasonable effort will be made to promptly repair the inoperative equipment. No refunds will be made for inoperative air conditioners, appliances or mechanical failure. Renters are responsible for leaving the rental property in like condition at departure.

DESCRIPTIONS AND RATINGS  Every rental property is rated according to condition and amenities to help with your selection. See Rental Property Rating. Every effort has been made to ensure that property ratings, descriptions, and distances to area attractions: ski, golf, beach, and water access are accurate; however, HVR is not responsible for changes made to furnishings or equipment, or errors in descriptions.

OCCUPANCY  Holiday Vacation Rentals will not allow overcrowding of the rental beyond the occupancy limit specified for the property. Renters will be subject to eviction, loss of any security deposit, and entire rental payment if over-occupancy occurs.

AGE REQUIREMENTS The person making this reservation is an adult of 21 years of age or older. All occupants of single family properties must be either (1) the renter(s) named on the Rental Confirmation and Agreement (if unrelated parties) (2) 21 years of age or older (3) direct descendants of the Renter (such as children, grandchildren, or great-grandchildren), (4) direct ancestors of the Renter (such as parents or grandparents) (5) siblings of the Renter, and/or (6) a maximum of one additional person for each direct descendant, direct ancestor, or sibling of the occupants.

PETS are only permitted in rentals indicated as pet friendly and are limited to two (2) domestic adult dogs (no puppies). There is a pet cleaning fee of $150.00. Pet owners are responsible for additional charges resulting from damages, clean up of outside yards or extermination services that become necessary. IF AN UNAUTHORIZED OR UNREPORTED PET HAS BEEN IN ANY RENTAL, PET FRIENDLY OR NOT, THERE WILL BE A CHARGE OF $250.00.

ITEMS LEFT BEHIND  Holiday Vacation Rentals is not responsible for items left in homes. Please double-check your rental for personal items prior to departure. There is a $50 return item fee plus the cost of shipping.

LOCKOFFS may contain owner’s personal property. Please respect these locked closets, cabinets, or rooms. They are NOT INCLUDED as part of your rental.

RESTRICTIONS  Rental guests are required to abide by rules and regulations for the property in which they stay. A guest services guide is located in the property and includes applicable rules and regulations along with specific guidelines for the rental property, check-out procedures, emergency numbers, and other pertinent information. Some locations may have restrictions for no RV, boat, or camper parking on the premises.

SMOKING is not permitted in any Holiday Vacation Rental Properties. If smoking has occurred in any rental, a minimum $250.00 cleaning charge will be assessed.

TERMINATION  If Renter or any member of his/her party violates the terms and conditions of this Agreement, then Holiday Vacation Rentals may, at its sole discretion, terminate this Agreement with no refund of the unused portion of the rental payments and enter the premises and remove Renter, the members of his/her party, and their belongings. A material breach of this Agreement shall include, but not limited to, failure to comply with these terms and conditions, damage to the property through negligence or misuse, or failure to check out on a timely basis.

LIMITATIONS OF REMEDIES, DAMAGES AND INDEMNITY a) In the event of fire, eminent domain, delay in maintenance, or any other reason whatsoever affecting the Renter's access to the property, Renter agrees that Holiday Vacation Rentals or Owner's sole liability as a result of any such condition is a refund of the prorated rental for each day Renter is unable to use the property. b) Renter understands that there are inherent risks associated with any property, including risks associated with any special feature, such as a pool, hot tub, sauna, fireplace, etc. Renter represents and certifies that he/she is thoroughly familiar with how to properly use the rental property, including all special features included in and on the premises. Renter will be responsible for use of the property by Renter’s guests. Renter agrees to indemnify and release the Owner and Holiday Vacation Rentals from and against all liability or loss, should anyone be injured upon the premises during the term of this rental, resulting from any cause whatsoever, except in the case of a personal injury caused by the negligent act of the Owner. Renter further agrees that Renter is responsible and liable for, and will pay upon request, any damages that occur to the property or any portion thereof due to Renter’s or his/her guest’s misuse, or negligent use of the property or any portion thereof. c) Renter shall not be entitled to any refund or rebate due to delay in check-in, early check-out, unfavorable weather, temporary disruption of utility services, malfunctioning, missing, or dissatisfaction with equipment/appliances/furnishings or condition of property, construction and associated noise. d) Renter agrees to hold Owner and HVR harmless of any liability for injury or damage to self resulting from accident, injury, or loss of enjoyment resulting from weather, inoperable appliances, or equipment including but not limited to hot tub or BBQ grill. e) Renter is liable for charges for lost key(s), garage door openers, TV remotes, and damages from pets.

CHECK-IN time is at or after 4 PM on the arrival date. If you are unable to check-in before our offices close, please call for late arrival check-in instructions. We can only arrange a late check-in if your balance has been paid in full.

CHECK-OUT time is 10 AM. Please observe this rule as housekeeping staff needs time to prepare for our next guests. Upon leaving, please secure all windows and doors, wash dishes, and clean out the refrigerator. Trash should be placed in the location designated in your rental's guest services guide.Leave all towels in the home and leave the used beds unmade. Unless otherwise designated, keys should be placed in the key drop at the check-in location. Renters are responsible for leaving the rental property in a like condition of arrival upon departure. If your rental requires extra cleaning because you left it in poor condition, you may be charged an additional cleaning fee. Two (2) keys will be issued at check-in. There is a $50.00 per key charge for each key not returned.

EARLY CHECK-IN AND LATE CHECK-OUT  Call our office for pre-approval. Holiday Vacation Rentals cannot guarantee your rental will be ready at 4:00 PM due to housekeeping and maintenance of the property prior to check-in. Late check-outs must be approved by our office at least one day prior to your departure date. Requests cannot be guaranteed before this date, and late check-outs will be approved only if it does not conflict with housekeeping and maintenance schedules, and/or arriving guests on your departure date.  LATE CHECK-OUTS MAY BE CHARGED UP TO AN ADDITIONAL ONE (1) NIGHT RENTAL IF PROPERTY IS OCCUPIED AFTER CHECK-OUT TIME WITHOUT APPROVAL.

The Renter understands all rules, charges, and fees that may be levied and authorizes Holiday Vacation Rentals to charge any fee due resulting from violations to this Agreement to his/her credit card.
